By downloading this mobile application you are agreeing to be bound by these Terms of Use, all applicable laws and regulations and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, do not use this mobile application. Any claim relating to The Regional Municipality of York’s (“York Region”) (as hereinafter defined) mobile application shall be governed by the laws of the Province of Ontario without regard to its conflict of laws provisions. All material contained within York Region's mobile application is protected by applicable copyright and trademark law.

Disclaimer of Warranties

The information on this mobile application has been provided as a public service. Although every attempt has been made to ensure its accuracy, The Regional Municipality of York ("York Region") makes no warranties or representations, express or implied, concerning the accuracy, reliability or completeness of the information contained on this mobile application. To the fullest extent permissible pursuant to applicable law, York Region disclaims all warranties, expressed or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose. York Region does not warrant that the functions contained in the materials will be uninterrupted or error-free, that defects, if any, will be corrected, or that York Region's mobile application or the server that makes them available are free of viruses or other harmful components. York Region makes no representation that materials in York Region's mobile application are appropriate or available for use in other locations. York Region disclaims all responsibility for and does not warrant the accuracy, completeness or timeliness of the geospatial information presented throughout this site, including but not limited to maps, graphics, applications and technology; or the fitness of said information for a particular purpose. This mobile application is being provided for your personal non-commercial use. Any information, software or products contained on this mobile application may be used, downloaded and printed for non-commercial purposes provided the content of the mobile application is not modified, in whole or in part and that every copy of the downloaded or printed information is accompanied by this disclaimer notice and copyrights. By using this mobile application you agree not to use the data obtained from the mobile application for solicitations, commercial or otherwise; use any data obtained from the mobile application as part of a commercial product, service or content offering; sell or otherwise distribute any data obtained from the mobile application; incorporate any data from the mobile application into any email or competing products; or use the data in a manner which could be reasonably expected to offend a person for whom the data is relevant.

The information, software and products contained on this mobile application shall not be modified, copied, distributed, reproduced, published, licensed, transferred or sold for a commercial purpose, in whole or in part, without the written consent of York Region.

Collection of Information

York Region supports the personal right to Privacy and is committed to collecting and using your personal information responsibly. York Region is subject to the provisions of the Municipal Freedom of Information and Protection of Privacy Act (MFIPPA). MFIPPA requires that a local government protect the privacy of an individual's personal information that exists in its records and that it follow rules regarding the collection, retention, use, disclosure and disposal of personal information in its custody or control.

Your personal information is collected under the authority of sections 11(1) and 227(c) of the Municipal Act, 2001. The personal information will be used by York Region staff for responding to your service request and/or inquiry. York Region will only collect information vital to the functionality of the mobile application and basic analytics information to allow us to continue to improve the mobile application experience for our users. York Region’s mobile application does not require you to provide personal information about yourself. You may access it anonymously. The only personally identifying information arising from your use of the mobile application is what you supply, such as your email address.

Once you download the application, your unique ID device is sent to our hosting server so that update notifications and location notifications can be delivered to you. You can disable these notifications at any time using the settings page accessible via the “Gear” icon in the top right hand corner of the application Dashboard.

If you sign up for optional notifications, your location as a latitude and longitude, and the details of the notification you would like to receive are collected and stored so that we can send you the appropriate notification. You can disable these notifications at any time using the settings page accessible via the “Gear” icon in the top right hand corner of application Dashboard.

Page visits within the York Region mobile app are recorded solely for analytics purposes but cannot be tied back to an individual as only a unique “device id” is transmitted to our hosting server. The type of device being used such as the user agent and device type (Windows Phone, IOS, Blackberry 10, etc) is also stored. These analytics are viewable by York Region as well as the application developer.

When a “report” is submitted within the mobile app, the third-party hosting servers relay the information to York Region and may keep the report information in the hosting database so that York Region can view it from the secure portal.

All data noted in this statement is transmitted to the hosting server over the HTTPS secure protocol.

Under no circumstances will York Region provide collected information to any third party with the exception of the analytics noted above unless compelled by a court order or applicable law.
